BOARD OF SUPERVISORS’ RESOLUTION

RESOLUTION NO. XXXXX

RESOLUTION ASSUMING the exercise of the powers and duties of township trustees relating to fire protection service and emergency medical service for the unincorporated area of Oto Township, Woodbury County, Iowa.

WHEREAS, section 359.42 (Code of Iowa) states that “The trustees of each township shall provide fire protection service for the township”; and

WHEREAS, section 28E.32 (Code of Iowa) states that “A municipality that agrees to provide fire protection service or emergency medical service for another municipality shall do so in writing”; and

WHEREAS, The Oto township trustees have failed to sign a fire protection agreement(s) in accordance to the above codes of the State of Iowa as of August 17, 2004 ; and

WHEREAS, The City of Danbury, Fire Department, in the best interest of the residents of Oto Township has requested that the Woodbury County Board of Supervisors assume the exercise of powers and duties of township trustees relating to fire protection service and emergency medical service for the unincorporated area of Oto Township, Woodbury County, Iowa in accordance with Section 331.385 (Code of Iowa); and

NOW, THEREFORE, BE, AND IT IS HEREBY RESOLVED by the Woodbury County Board of Supervisors, Woodbury County, State of Iowa, shall assume the exercise of powers and duties of township trustees relating to fire protection service and emergency medical service for the unincorporated area of Oto Township, Woodbury County, Iowa
